Keating’s son charged with assault

PATRICK KEATING, the 29-year-old son of the former prime minister, has been charged with assault after allegedly attacking a solicitor in Elizabeth Bay last month.

The assault on the Brisbane solicitor, Robert Herd, 42, is believed to have stemmed from a dispute over a Vanuatu property scheme run by Keating jnr’s father-in-law, Bruce McDonald, in which Paul Keating has also invested.

After attending Kings Cross police station on Saturday with his barrister, Patrick Keating was charged with assault the next day. He has denied the allegations.

About 7.15pm on April 24, Mr Herd, who advises the Vanuatu Government on strata title legislation, was opening the door to his Elizabeth Bay apartment when four men, including Keating and Mr McDonald, 65, allegedly confronted him.

Mr Herd had gone home after being told someone had been trying to break into his garage. A magistrate who lives in the building told police she saw men armed with a chainsaw outside the apartment block that afternoon. When Mr Herd arrived, Mr McDonald and Keating demanded the return of documents. A witness has told police that Mr Keating shouted: “Give me my stuff back, you f—ing c—.”

When Mr Herd said, “Don’t talk to me like that,” Keating allegedly pulled him through the doorway and threw him to the ground. Mr Keating and two other men are allegedly punched the lawyer as he lay on the floor.

The witness, a clerk for a group of Sydney barristers, called police but Keating allegedly left.

The Herald understands Mr Herd and Mr McDonald were in dispute over Ocean Blue Estates, a Vanuatu property scheme that Mr McDonald had run out of a Double Bay office. While Paul Keating is understood to have a half-interest in the property, bought last year for $1.55 million, he has not been involved in the dispute.

Mr McDonald is currently banned as an investment adviser by the Australian Securities and Investments Commission for failing to act ethically or honestly over a 1996 investment scheme involving cattle embryos.

Leon Wicht, formerly a policeman for 37 years, lost $400,000 on a Coffs Harbour property deal that led to Mr McDonald being charged with deception offences. While he was committed for trial in 2003, the Director of Public Prosecutions withdrew the case.

“His philosophy,” Mr Wicht claims, “is pay yourself handsomely first and the rest can wait, litigate or go to hell.”

Late last year, the Tax Office instituted bankruptcy proceedings against Mr McDonald, but he has settled. The Herald understands at least one investor in his current Vanuatu property scheme has made a complaint about him to the NSW fraud squad.

ASIC documents show several companies of which Mr McDonald and his daughter, Amber, 34, are directors have been wound up after creditors took action in the Supreme Court. Amber, a former model, married Keating in 2002.

He will face court on July 3. The Herald has been unable to reach him or Mr McDonald.
