Byrnes’s lawyer told police to back off or face legal action

THE coronial inquest into the possible murder of Max Gibson yesterday turned its attention to the colourful Sydney entrepreneur and one-time bankrupt Jim Byrnes.

Gibson, 30, died of a heroin overdose, believed to have been a “hot shot” (a lethal injection), in March 2001 while he was in the middle of an arson trial.

This was the second trial for Gibson and his co-accused, Tony Vincent jnr, who had been charged over the fire-bombing of a house in Tara Street, Woollahra, which Mr Byrnes was in the process of buying.

The pair was arrested within hours of the bombing, after part of Gibson’s buttock and his wallet were found at the scene of the crime, as was Vincent’s shoe. The pair also suffered severe burns.

Glebe Coroners Court has heard Mr Byrnes and the underworld figure Tony Vincent snr were long-time friends and, shortly before his death, Gibson told his father that he had burned down the property and that, “I did it for Tony Vincent and Jim Byrnes.”

The court heard yesterday Mr Byrnes refused to co-operate with police investigating the arson. Six months after the bombing, a Rose Bay detective, Charles Poniris, received a letter from Mr Byrnes’s lawyer, Brett Galloway. The letter threatened him with a restraining order should he try to interview Mr Byrnes again.

Mr Byrnes said yesterday he did not sanction the letter and that it was not his style.

He said that as he had spent “22 months incarcerated as a guest of Her Majesty”, he did not trust police or their methods. Mr Byrnes was jailed in 1986 for the deemed supply of heroin.

Counsel assisting the coroner, Pat Saidi, also asked Mr Byrnes about the evidence he had given at Gibson’s first arson trial in March, 1998. While agreeing with Mr Saidi that he had known Gibson for 18 months before his death, Mr Byrnes was then read answers he had given at the trial.

Q: “Do you know Max Gibson who is sitting next to Tony Vincent jnr?” – “I do now.”

Q: “Did you know him before the day of the explosions?” – “Not to speak to, no.”

Mr Byrnes denied lying at the arson trial, insisting yesterday that his answers weren’t untruthful, just “grammatically incorrect”. He also denied being part of a conspiracy to pervert the course of justice during the trial.

His evidence continues today.
